After you have suffered a workplace injury, it is crucial to seek medical attention, even if you do not feel that you have seriously been injured. A doctor\u2019s report immediately following your injury is the important first step in your successful claim for compensation benefits. It is essential that you see a doctor that is certified by New York State to treat Workers\u2019 Compensation patients. If you go to a non-certified doctor, your Workers\u2019 Compensation may be invalid. The most important element to your compensation claim is your doctor\u2019s report. These reports will be filed with your insurance company and the Workers\u2019 Compensation Board after each visit. Always make sure that you have updated reports from your doctor before any hearing. Regular treatment is important in establishing your case and getting you paid.<\/p>\n
To receive workers’ compensation benefits, an employee must prove that there is or was an injury, illness or disability arising out of and in the course of employment, and that adequate notice to the employer was given. Please note that even if you do not file a compensation claim immediately, you may do so up to two years after your accident. That is why it is important to always let your doctor know the cause of your injury. In order to establish a case, the injured worker must have a medical report stating that a work-related accident or condition was the cause of the injury, illness or disability. Without a medical report stating this, the Workers’ Compensation Board will not consider the case.<\/p>\n
Occupational diseases are also covered by workers’ compensation. An occupational disease is a condition which is caused by the specific type of job over a period of time. An example of an occupational disease is a wrist injury due to long term computer use. If your disability prevents you from working, you must see a Workers\u2019 Compensation Certified doctor on a regular basis. Disability can only be proved with medical reports.<\/p>\n
Remember, you can be treated for injuries sustained at work at no cost and be paid for your time out from work as long as proper documentation is provided. Even when you return to work, you can still receive treatment free, as long as the \u201cpaper work\u201d has been done properly. Dr. Mollins and all of his referred medical specialists are certified to treat Workers\u2019 Compensation patients and they are meticulous with all documentation so that every person injured at work will receive proper compensation as expeditiously as possible.
